THE ARBITRATION AND CONCILIATION ACT, 1996:<\/em> SEC 8.<\/em><\/em><\/p>\n\n\n\n

CHAPTER II: ARBITRATION AGREEMENT SEC 8:<\/em><\/p>\n\n\n\n

8. Power to refer parties to arbitration where there is an arbitration agreement.<\/em><\/strong><\/p>\n\n\n\n

(1) A judicial authority, before which an action is brought in a matter which is the subject of an arbitration agreement shall, if a party to the arbitration agreement or any person claiming through or under him, so applies not later than the date of submitting his first statement on the substance of the dispute, then, notwithstanding any judgment, decree or order of the Supreme Court or any court, refer the parties to arbitration unless it finds that prima facie no valid arbitration agreement exists.<\/em><\/p>\n\n\n\n

(2) The application referred to in sub-section (1) shall not be entertained unless it is accompanied by the original arbitration agreement or a duly certified copy thereof.<\/em><\/p>\n\n\n\n

Provided that where the original arbitration agreement or a certified copy thereof is not available with the party applying for reference to arbitration under sub-section (1), and the said agreement or certified copy is retained by the other party to that agreement, then, the party so applying shall file such application along with a copy of the arbitration agreement and a petition praying the Court to call upon the other party to produce the original arbitration agreement or its duly certified copy before that Court<\/em><\/p>\n\n\n\n

(3) Notwithstanding that an application has been made under sub-section (1) and that the issue is pending before the judicial authority, arbitration may be commenced or continued and an arbitral award made.<\/em><\/p>\n\n\n\n

Section 8 Explained Step by Step (with Guruji\u2019s punch)<\/strong><\/p>\n\n\n\n

Sub-section (1): The Big Gatekeeper \ud83d\udeaa<\/strong><\/p>\n\n\n\n

Suppose two friends Ramesh & Suresh sign an agreement with a clause:
\u201cIf fight comes, we won\u2019t trouble Court uncle \ud83d\udc68\u200d\u2696\ufe0f, we\u2019ll go to Arbitrator dadaji \ud83d\udc74.\u201d<\/strong><\/p>\n\n\n\n

Now, if Ramesh files a case in Court saying \u201cSuresh cheated me in business \ud83d\uded2\ud83d\udcb0\u201d\u2026<\/strong><\/p>\n\n\n\n

Court uncle will say:
\u201cBeta, I\u2019ll only touch this case if there is no valid arbitration agreement<\/em>. Otherwise \u2192 Go to arbitrator! \ud83c\udfc3\u200d\u2642\ufe0f\u27a1\ufe0f\u2696\ufe0f\u201d<\/strong><\/p>\n\n\n\n

\u26a1 Condition: The party must apply before filing their first statement<\/em> in court.
(If you already gave your first statement \u2192 too late! \ud83d\ude05)<\/strong><\/p>\n\n\n\n

Sub-section (2): The Document Check \ud83d\udcdc\ud83d\udd0d<\/strong><\/p>\n\n\n\n

Court uncle says: \u201cShow me proof of this arbitration pact! Don\u2019t just say \u2018we agreed\u2019 and vanish.\u201d<\/strong><\/p>\n\n\n\n

You must attach:
\u2705 The original arbitration agreement OR
\u2705 A duly certified copy.<\/strong><\/p>\n\n\n\n

If you don\u2019t have it, but the other party is hiding it in his almirah \ud83d\uddc4\ufe0f, you can request Court uncle:
\u201cPlease order him to bring it out!\u201d \ud83d\ude4f<\/strong><\/p>\n\n\n\n

Sub-section (3): Double Track Allowed \ud83d\ude82\ud83d\ude82<\/strong><\/p>\n\n\n\n

Even while the matter is still pending in Court (deciding whether to refer to arbitration), the arbitration process can start or continue.<\/strong><\/p>\n\n\n\n

Court uncle checks:<\/strong><\/p>\n\n\n\n

Is there an arbitration clause? \u2705 Yes.<\/strong><\/p>\n\n\n\n

Did Builder apply before filing his statement? \u2705 Yes.<\/strong><\/p>\n\n\n\n

Arbitration agreement shown? \u2705 Yes.<\/strong><\/p>\n\n\n\n
