CHAPTER I: General provisions

THE ARBITRATION AND CONCILIATION ACT, 1996: SEC 4.

4. Waiver of right to object.—A party who knows that—

(a) any provision of this Part from which the parties may derogate, or

(b) any requirement under the arbitration agreement,

has not been complied with and yet proceeds with the arbitration without stating his objection to such non-compliance without undue delay or, if a time limit is provided for stating that objection, within that period of time, shall be deemed to have waived his right to so object.

⚖️ What the Section Says in Simple Guruji Style

If you know –
(a) Some rule (which can be changed by agreement) is not followed, OR
(b) Some condition in your arbitration agreement is broken…

And still, you keep quiet and continue the arbitration 🪑🫖 without raising objection immediately (or within the time limit)…

Then later you cannot suddenly object. 😲❌
Law will say: “Boss, you had your chance, but you waived it. Now don’t do last-minute drama!” 🎭

“Arbitrator sir! 9 AM rule was never followed! This arbitration is invalid!” 🤯
